Definition of Offshore Trust

An offshore trust is simply a regular or traditional trust that is formed and administered under the laws of an offshore jurisdiction. In the establishment and operation of an offshore  trust the governing or applicable law is different from that of the creator's or settlor's country of residence; instead, the offshore trust is governed by the law of one of the world's many offshore financial centers such as Belize or the Seychelles that recognize the concept of the trust.

An offshore trust is a legal entity created in the trust agreement that enables the settlor, creator, or grantor, who establishes the trust and places his assets into trust, to protect his or her assets against future creditors, lawsuit judgments, divorces, or other legal and financial calamities.

One essential offshore trust feature that differentiates an offshore trust from an onshore trust is portability. Under the permissive and liberal laws of most asset havens and tax havens, the offshore trust can be transferred easily and quickly to alternative jurisdictions to maintain confidentiality and to benefit from the many special advantages offered to offshore trusts in a particular tax haven or asset haven.
